Yushchenko did not call into question legitimacy of foreign minister’s dismissal
The decision on dismissal of Ukraine’s Foreign Minister Boris Tarasyuk was made by the Ukrainian Supreme Rada and came into force since the moment of its adoption. If we stick to the law, Tarasyuk is considered to be dismissed, Ukraine’s President’s Permanent Representative at the parliament Roman Zvarych said today, on December 4, a REGNUM correspondent in Kiev reports citing Our Ukraine Party press office.
Roman Zvarych noted that there are at least two opportunities to suspend this decision. The easiest way is for Boris Tarasyuk to file an action to Pechersky Court under administrative procedure. The court is to define whether the Supreme Rada abused its powers making such decision. There are grounds for such a claim, Zvarych said. The second opportunity is sending an appeal to the Constitutional Court on the same issue, but under a constitutional procedure. This can be done by MPs or the president, he noted. However, I am unaware of any intentions by the president to introduce such an appeal to the Constitutional Court, at least I have not received any instructions about it, Roman Zvarych stressed.
It is worth mentioning, on December 1, Ukraine’s Supreme Rada gave its consent for dismissing Foreign Minister Boris Tarasyuk. 247 MPs (186 from Regions Party, 30 from the Socialist Party, 21 from the communist Party, 4 from BYT faction, 2 from Our Ukraine and 4 non-party) voted for the decision. Boris Tarasyuk appointed to the Yanukovich government under presidential quota said commenting on the decision that the legal collision around appointing and dismissing foreign minister and defense minister can be settled by the Constitutional Court only. Whatever the decision of the Supreme Rada is, reaction of the president will certainly follow; the issue can be settled through the Constitutional Court only. Several Our Ukraine MPs support the same position.
